Terms of service
Last updated: September 4, 2026. These terms govern your use of the EstateTagSale website and of the EstateTagSale software service, published by MLJ, SASU.
1. Acceptance
By using estatetagsale.com, submitting the contact form, or opening an EstateTagSale account, you accept these terms on behalf of yourself and the company you represent. If you do not accept them, do not use the service. Where a signed order form or written agreement between your company and MLJ, SASU says something different, that document takes precedence over these terms for the points it covers.
2. The service
EstateTagSale is a web based system for estate sale companies. It provides item cataloging with photographs and prices, tag numbering issued by room or crew member, a markdown schedule with category holdbacks, a sale day register that records cash, card and split payments against tag numbers, management of holds, deposits and pickup windows, storage of contracts and crew records per sale, and generation of an itemized settlement statement showing gross by category, commissions and expenses. The service does not appraise property, does not list items to auction platforms, and does not process card payments. You keep your own payment processor, your own appraiser and your own insurance.
3. Accounts and eligibility
You must be at least eighteen years old and authorized to act for the business that holds the account. You are responsible for the accuracy of the account details, for the conduct of every crew member you invite, and for keeping credentials confidential. Tell us promptly at jimenezjulien42@gmail.com if you believe an account has been accessed by someone who should not have it, and we will help you lock it down.
4. Acceptable use
Use the service for running estate sales and settling with the families who own the goods. Do not use it to catalog or sell items you are not legally entitled to sell, do not attempt to access another company's catalog, do not probe or interfere with the infrastructure, do not resell or sublicense access, and do not upload material that infringes someone else's rights. Regulated items that turn up in a house, including firearms, prescription medication and certain wildlife products, remain your legal responsibility to handle correctly under federal and state law, whatever the catalog records.
5. Subscription and billing
Plans are One Crew at $49 per month, Company at $109 per month and Multi Crew at $219 per month, quoted and billed in US dollars. Subscriptions are billed monthly in advance on the calendar day you started, and each plan renews automatically for a further month until you cancel. Prices exclude any sales or use tax your state imposes on software services, which is added where applicable. There is no setup fee, no per sale fee and no commission on your gross. If we change published prices, existing subscribers are told at least thirty days ahead and the new price applies from the following billing period.
6. Cancellation and refunds
You may cancel at any time from your account settings, effective at the end of the current billing period, with no cancellation fee and no notice period. We do not prorate refunds for a month already started, except where required by law or where a service failure on our side made the month unusable, in which case write to us and we will make it right. Changing between plans takes effect the same day and the next invoice is prorated. After cancellation your data stays available for export for thirty days, after which it may be deleted.
7. Your data
The catalogs, photographs, buyer records and settlement statements you create remain yours. You grant MLJ, SASU only the limited license needed to host, back up, display and process that content so the service works for you. We do not sell your data, we do not mine your buyer lists, and we do not use your catalogs to advertise to your customers. You can export everything in a standard format at any time. Personal data is handled as set out in the privacy policy.
8. Service availability
We aim for the service to be available at all times and we schedule maintenance away from Friday, Saturday and Sunday, because those are sale days. Tagging and register functions continue to work on a device that loses its connection and synchronize when a signal returns. We do not promise uninterrupted availability, and outages caused by hosting providers, network carriers or events beyond our reasonable control are excluded from any commitment.
9. Warranty disclaimer
The service is provided as is and as available. To the fullest extent permitted by law, MLJ, SASU disclaims implied warranties of merchantability, fitness for a particular purpose and non infringement. We do not warrant that the software will suit every sale, that prices you set will be achieved, or that a settlement statement will satisfy every executor, attorney or state authority. You remain responsible for reviewing the numbers before you send anything to a family.
10. Limitation of liability
To the extent permitted by law, MLJ, SASU is not liable for indirect, incidental, special or consequential damages, including lost profits, lost sales, lost referrals or lost goodwill. Our total liability for any claim connected with the service is limited to the subscription fees you paid in the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.
11. Indemnity
You agree to indemnify MLJ, SASU against claims, damages and reasonable legal costs arising from your use of the service in breach of these terms, from content you upload, or from a dispute between you and a family, an executor, a buyer or a crew member relating to a sale you ran.
12. Changes to these terms
We may update these terms to reflect changes in the service or in the law. Material changes are announced by email to account holders at least thirty days before they take effect. Continuing to use the service after that date means you accept the revised terms. The version published on this page is always the one in force.
13. Governing law and contact
These terms are governed by French law, and any dispute that cannot be settled amicably will be brought before the competent courts of Paris, France, without prejudice to mandatory consumer protection rules that may apply where you live.
